BetterHost provides web hosting, server management, and related digital services (collectively, the "Service"). We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice, although we will attempt to provide reasonable notice for significant changes.
3. Account Registration & Security
- Eligibility: You must be at least 13 years old (or the legal age of majority in your jurisdiction) to use our services.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are responsible for maintaining the confidentiality of your account credentials. BetterHost is not liable for any loss or damage arising from your failure to protect your account information.
4. Acceptable Use Policy (AUP)
You agree not to use the Service for any unlawful or prohibited activities. The following are strictly prohibited:
- Illegal Content: Hosting content that violates local, state, national, or international laws (e.g., child exploitation, pirated software, fraudulent sites).
- Malicious Activity: Distributing malware, viruses, trojans, or engaging in phishing.
- Network Abuse: DDoS attacks, botnets, port scanning, or any attempt to disrupt the integrity of our network or third-party networks.
- Spam: Sending unsolicited bulk emails or spam.
Violation of this AUP may result in immediate suspension or termination of your account without refund.
5. Payment and Refunds
- Billing: Services are billed in advance on a recurring basis (monthly/yearly) depending on your selected plan.
- Late Payments: Failure to pay by the due date may result in service suspension. Data may be deleted if payment is not received within a specified grace period.

6. Service Availability (SLA)

7. Data Backups and Loss
While we may perform courtesy backups for certain shared hosting plans, you are solely responsible for maintaining your own backups. BetterHost is not liable for any loss of data, whether due to hardware failure, human error, or hacking.
8. Limitation of Liability
To the maximum extent permitted by law, BetterHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.
9. Termination
We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
10. Governing Law
